Terms of use
Terms for the BARAQ mobile app, web administration and cloud services.

1. Operator and scope
The service is operated by BARAQ SMART SYSTEMS s.r.o., Company ID 23050055, with its registered office at Úvoz 493/29, Staré Brno, 602 00 Brno, Czech Republic. These terms govern the use of the BARAQ app, the web administration, the customer account, remote access and the cloud services. The supply and installation of hardware may be governed by a separate order or contract; individually agreed arrangements take precedence.
2. Account and activation key
The user creates an account using an activation key, an invitation or other verification linked to the installation. The user must provide accurate information, protect their means of logging in and report any suspected misuse without undue delay. The user must not make the activation key or access available to an unauthorised person.
3. Roles and household members
The service may distinguish between an owner, an administrator, a regular member and a guest. The owner or administrator may invite other persons and change their permissions. They are responsible for adding only authorised persons, granting them appropriate access and removing it as soon as it is no longer needed. The service must not be used for covert or unlawful monitoring of persons.
4. Safe control of the system
The app may physically control doors, gates, security, air conditioning, charging and other devices. Before issuing a command or setting up an automation, the user must consider its consequences and must not endanger the life, health, property or rights of other persons. The app is not the sole means of controlling vital equipment unless the relevant function is expressly intended for that purpose.
5. Location-based functions
Location-based functions, such as automatic gate opening, are voluntary and require a system permission. The user must verify the location, the activation conditions and the safety of the surroundings. The accuracy and availability of location depend on the phone, the operating system, the signal and the connection; we therefore do not guarantee that the function will always be carried out, immediately or at a completely precise location.
6. Cloud services and payments
Some functions may require a paid cloud service and an internet connection. The price, billing period, scope of the service, any automatic renewal and the method of termination will be clearly stated to the user before ordering. Cancelling the account may not in itself end a subscription concluded through an external app store; such a subscription must also be cancelled with the relevant provider.
7. Availability and updates
We strive for safe and reliable operation, but we cannot guarantee uninterrupted availability. Operation may be affected by maintenance, the internet, electricity, device failure, an external supplier or a security incident. We provide the updates necessary for functionality, compatibility and security; the user shall allow them to be installed within a reasonable time. This does not affect the statutory rights of consumers.
8. Prohibited use and restriction of access
It is prohibited to circumvent security, disrupt the service, access other people’s accounts or installations, spread malicious code, monitor other persons without authorisation or use the service unlawfully. In the event of a serious breach, we may restrict access or block the account. Where possible, we will notify the user in advance and give them the opportunity to remedy the situation.
9. Minors
A paid service is ordered by an adult or by another person with the capacity to enter into a contract. A legal representative may add a minor member and is responsible for setting their permissions and for supervision. A minor should not be granted security-sensitive permissions unless these are appropriate to the minor’s age and abilities.
10. Liability
BARAQ is liable to the extent provided by law. BARAQ is not liable for the consequences of improper use, incorrect settings made by the user, making the account available to an unauthorised person, failure to install an update, a failure of a third-party device or service, or an outage of the internet or electricity. This provision does not limit liability that cannot be excluded by law, nor the rights of consumers.
11. Licence and account termination
We grant the user a non-exclusive and non-transferable right to use the app for their own needs for the duration of the account or licence. The account can be cancelled in the app or via info@baraq.cz. Cancellation may end remote access, household membership, personal settings and cloud functions. We retain certain data where required by law or for the protection of legal claims.
12. Complaints and consumer disputes
A complaint (claim for defects) can be made at info@baraq.cz or at the company’s registered office. Consumers have rights arising from defective performance under the Czech Civil Code, including the rules for digital content, digital services and goods with digital elements. The Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, www.coi.cz, is competent for the out-of-court resolution of consumer disputes.
13. Changes and governing law
We may reasonably change these terms because of legislation, security, technical development or changes to functions. We will inform users of any material change in advance. Legal relationships are governed by the law of the Czech Republic; this does not affect the mandatory rights of consumers in the place of their habitual residence.
